CoE calls Serbia to implement Court ruling on missing babies

The Committee of Ministers holds quarterly meetings devoted to the implementation of rulings by the European Court of Human Rights by CoE member states.
The Committee recalled in its statement that the court ordered Serbia to “secure the establishment of a mechanism aimed at >> Pročitaj celu vest na sajtu N1 televizija << providing individual redress to all parents of missing babies”.
The Court ruled in 2013 on the case of Zorica Jovanovic whose son is alleged to have died in a maternity ward in 1983 and ordered the state of Serbia to take all appropriate measures to secure the establishment of a mechanism aimed at providing individual redress to all parents in a situation similar to Jovanovic’s.
The Committee of Ministers called the Serbian authorities to provide information by October 1, 2018 on the measures taken to adopt a law and introduce the mechanism ordered by the Court.
The Committee will re-examine the case at its meeting in December 2018 to see if the necessary measures have been adopted. If that is not the case, the Committee will look into the matter at each of its meetings on human rights until the Serbian authorities introduce the measures, a statement said.
The Serbian government submitted a draft law on the missing babies to parliament on March 8, 2018 but it has not been adopted yet.
