Bosnia Court orders retrial of Srebrenica commander
The Appeals Chamber of Bosnia’s State Court abolished a lower court acquittal and ordered the re-trial of the wartime commander of Bosniak forces in Srebrenica and one of his soldiers on war crimes charges, the Balkan Investigative Network (BIRN) reported on Monday.
The report of the re-trial of Naser Oric and his trooper Sabahudin Muhic was confirmed for BIRN by the Prosecution but Oric’s lawyer, Lejla Covic said she had not been informed of the ruling.
The BiH State >> Pročitaj celu vest na sajtu N1 televizija << Court acquitted Oric and Muhic last October following a trial for the alleged killing of three Serb prisoners in the villages of Zalazje, Lolici and Kunijerac in 1992.
The Prosecution appealed the ruling early in May and requested a re-trial, saying that the facts had not been presented properly in court.
Prosecutor Miroslav Janjic said the ruling was unprecedented because it is based on an imaginary piece of evidence. The court, he said, pronounced one verdict but then sent another in writing.
“The Council says in its verdict that it will apply the case law of the International Criminal Tribunal for former Yugoslavia, ICTY, and will not consider every piece of evidence individually and connect them, which is contrary to the Law on Criminal Procedure in this country,” Janjic said.
The defense filed a motion to dismiss the Prosecution’s request and confirm last October’s acquittal, arguing that the request of the Prosecutor was “confusing, unclear and not understandable.”
